Post 1992 HAF (with Wells Fargo Bank complicity) is a case of trustees, rather than protecting the public's treasures left in their care (fiduciary responsibillity), are destroying them. Vera's watchdogs are stymied to stop this by the `no standing' in court approach of legal defense. Vera's watchdogs have spent 20 months (as of Mar 2001) and well into six figures in legal fees to try to stop HAF from further (after the 1995 fiasco) destroying the property, the public's LYNN VIETOR NATURE PRESERVE and the Vietor's architectually significant residence. A class of people, lead by such as Sierra Club, Earth First, The Alliance For A Paving Moritorium, can bring a suit for a simple injuction to keep HAF from further destroying the public's Lynn Vietor Nature Preserve. In an article in the North Coast Journal in recent weeks, HAF's Pennekamp is rather arrogantly quoted as saying he will `break ground' in a month or two. HAF has however evidently though better of proceeding in the last 20 months while litigation is still alive (Perrotts on Vera's behalf appealed to the California Supreme Court the first week of January 2001 then planning an appeal to the US Supreme Court). But HAF are still determined to pursue their wrongheaded to destroy Vera's treasures left entrusted to them. HAF had tractors at the site to start their `destruction' in August 1999, and have been stopped only by Vera's Perrott watchdogs `litigation'. But the Perrotts, turned down by the California Supreme Court (14Feb2001 now have 90 days to appeal to the US Supreme Court), are running out of legal options. Failing public intervention, get ready to hear HAF tractors and chain saws destroying the public's Nature Preserve unless the public comes to the rescue of its Lynn Vietor Nature Preserve and historic John Yeon architectural masterpiece which Vera Perrott Vietor left to be enjoyed by the North Coast public, not destroyed by what she would see as her duplicious and selfserving trustees, the Frankenstein monster she created, HAF (WFB). Jack Selvage was chairman of the HAF board in 1994 when HAF applied for a building permit to do the initial destruction to the residence and the north side of the house Lynn Vietor Nature Preserve (without getting court approval). Jack is listed in the Humboldt yellow pages as a firm offering 'environmental' engineering. He was (and still is) on HAF's Board, i.e. a trustee with the fiduciary responsibillity to protect the public's Lynn Vietor Nature Preserve. When questioned by the Perrotts in 1999, he admited to never having read Vera's will. Who is the minding the HAF store? Has anyone at HAF every heard of 'fiduciary responsibillity' or really read Vera's will? |
