HAF Board of Governors Appointment In the second paragraph of Vera's 1972 will she stated "the foundation has been created by a declaration of trust execute by me this date." Below is Section V of that document "Board of Governors" to oversee HAF's daily activities. This system was followed through 1992 and scraped post 1993.
(a) APPOINTMENTS: A Board Of Governors shall be appointed to direct the application of the income and principal of the fund or funds of the Foundation in all cases in which the respective donors thereof may not have specifically made provisions as provided in Articles II and III. The Board of Governors shall consist of seven (7) citizens and residents of the United States Of America and of the State of California residing in the County of Humboldt or within fifty (50) miles from the boundaries thereof, selected for their knowledge of public trust purposes, or any of them, as specified in Article I hereof Said Committee shall be appointed as follows: One Member by the Chairman of the Board of Supervisors of the County of Humboldt One member by the Presiding Judge of the Superior Court of the state of California, for the County of Humboldt One member by the President of the Humboldt Council of Chambers of Commerce. One member by the President of California State University, Humboldt One member by the President of College of the Redwoods One member by the President of United Way for the County of Humboldt All appointments shall be for five years, except that the appointments first made shall be for terms as follows. One member by the trustees committee for one year. One member by the Chairman of the Board of Supervisors of the County of Humboldt for one year. One member by the Presiding Judge of the Superior Court of the State of California, for the County of Humboldt, for two years. One member by the President of the Humboldt Council of Chambers of Commerce for two years. One member by the President of California State University, Humboldt, for three years. One member by the President of College of the Redwoods for four years. One member by the President of the United Way for the County of Humboldt for five years. Vera's Perrott watchdogs allege that there is something rotten in Denmark.
There is no record in Vera's Courthouse file of HAF approaching the Court
to get permission to scrap this part of Vera's trust agreement, appointment
of Board Of Governors. Jack Selvage, who was the chairman of the board
when the 1995 north of the house and residence `destruction' was applied
for (Humboldt County Planning) was nominated by the Humboldt Superior
Court. The Court first in 1999 ruled that the Perrotts had standing, then
reversed itself (under pressure?). Yes there must have been some `red
handed' and `red faced' trustees. HAF did not approach the court for permission
to destroy the Nature Preserve in 1995. They just did it, and only admitted
to the court that they had used invaded principal on approaching the court
for the 1999 `further building', telling the court, essentially, HAF and
WFB invaded principal last time in 1995, why not now? The Court agreed.
Vera and Watchdogs (who were not informed of the Court proceedingss and
not present) are not amused. The public should be outraged. See the 'bogus' Attorney General letter. Therein the Attorney General informs that no one but his office can approve a modification to a Trust or Foundation. The selection of Board Members is part of both the trust document and the Foundation. HAF, the Perrotts allege, did not have the right to alter that procedure without the AG's consent. HAF just did it, another illegal breach of fiduciary responsibility. |
